Foreclosure Q&A
What is pre-foreclosure?
Pre-foreclosure is the period of time leading up to the sale of a property for mortgage and/or tax delinquency. A pre-foreclosure property has not yet set at the auction and can still be sold by the existing homeowner.
How do I get assistance from my lender or other agency?
-
Never discontinue communication with your mortgage company. It is not necessary to pay a third party to arrange for a loan modification or other form of forbearance from your mortgage company. Call your lender directly to ask for a change in your loan terms.
-
A list of non-profit housing counseling agencies approved by the United States Department of Housing and Urban Development (HUD) is available at www.hud.gov.
What is the foreclosure timeline?
Once a homeowner begins defaulting in payments to a lender, the lender will send a demand letter to the borrower providing a final 20 days to bring the note current or face foreclosure. After continued non-payment, the lender will post the Notice of Trustee's Sale at the designated location per the Texas Property code and copy will be mailed to the homeowner. The property will be sold by a trustee on the 1st Tuesday of the following month.
Why should I avoid foreclosure?
-
It can lower your credit as much as 200-500 points or more
-
It can stay on your credit history for 7-10 years
-
You may not be able to buy another home for years
-
Renting a decent apartment could be more difficult wth a foreclsoure on your credit history
-
If the home is not your primary residence, the IRS may be able to issue a 1099 for the amount of the loan not paid back
-
You lose your home and any/all equity you may have had in it.
